帮朋友问下这种情况有没人遇到,有什么建议。双方交换合同了,可是还没付给对方定金之类的。双方律师是协商可以跟余款一起转账。可是银行那边说好打款的,突然贷款又不批了,购房被迫中止,这种情况算违约吗。怎么把损失降到最低?

Contract exchange是要交10%定金的,否则不是contract exchange.

你肯定还没有exchange contract,银行没有给你正式offer,律师是不会exchange的,银行给了offer也不会反悔

Binding offers were brought in with the Mortgage Credit Directive regulation in March 2016. The MCD says lenders cannot cancel or re-underwrite binding offers unless the borrower has given false information or there has been a “material change to the facts and circumstances” of the offer.
