我老公名下一套房子,想再买一套buy to let. 今天咨询律师,律师说第一套房子只有我老公的名字,第二套房子只在我的名下可以免交那3%的stamp duty。 是这样的吗?我一直以为结婚了不管房子只在一方名下,第二套还是要交那印花税的。

This solicitor is talking rubbish.
Anyway, he is supposed to collect tax on hmrc’s behaviour. If he didn’t collect extra 3% tax and you provided him with all information, the offence is committed by him not you.
Married couples & civil partnerships
For the purpose of property ownership, married couples and civil partnerships are seen as one unit. This means that if one person already owns a property, any subsequent residential purchase by either person will be seen as an additional property for both individuals.

律师说的是新政出来前的规定吧。作为律师应该对新政策理解透彻才对啊。

如果能有证据证明律师提供了各种信息(邮件之类的),之后有问题律师应该负责。他们也有职业保险可以保你的损失。不过3%应该是逃不掉的
