Gardnerspent five years in prison for that offense, but considerable outrage wasexpressed over the fact that he was no longer on parole at the time of themurders, despite numerous parole violations.The bill includes three mainprovisions.1. A one-strikeprovision for the most serious crimes against children younger than 18 putting even first-time offenders behind bars for life without the possibilityof parole2. The requiredlifetime parole with GPS monitoring of certain offenders those committing sexualcrimes against victims younger than 14 years old after theirrelease from prison3. A convicted sexoffender would be charged with a misdemeanor and a parole violation if foundnear a park where children frequent, resulting in a return to prisonThe proposed measure met oppositionfrom the California Public Defenders Association, and a challenge to the billis expected in the California Senate. Laws that substantially increasecriminal penalties are often the result of reactions to horrific crimes.Criminals rarely consider the consequences of their actions or stop to reflectbefore committing even the most egregious offenses. With the prison populationexpanding, many argue that resources should be utilized to prevent such crimesfrom occurring at all. For example, results of Californias three-strikes lawhave shown a negligible effect on overall recidivist rates.Supporters of enhanced sexoffender or sexual predator legislation often point to the reputedlyhigh recidivist rates for sex offenders, arguing that treatment andrehabilitation are useless or largely ineffective.
