One year after the introduction of the Gambling ActThe history of the latest amendment to the Gambling Act is long, complicated, rich in brawls and doubts. In the end, however, the rulers succeeded in voting through the version that is still in force today.The provisions of the Gambling Act were very controversial, some of them still cannot be accepted by some gamblers, but the battle dust has already subsided and we can look at the gambling market calmly.If you don't know the case or want to take a closer look at the provisions of the Gambling Act 2017, we have a thorough analysis of the new regulations that apply to both players and entrepreneurs.This time we want to look at the situation of bookmakers and online casinos in Poland. How did the legal revolution deal with them? Has anyone benefited from it?The gray market is shrinking.The aim of the amendment to the Gambling Act was to eliminate the so-called gray market of mutual betting and other gambling activities. Until the new law came into force, foreign bookmakers who did not pay taxes in Poland and made their services available under European Union law attracted Polish players with their winnings - not burdened with high Polish tax. The State Treasury lost even hundreds of millions of zlotys a year in this way.According to the Association for the Liquidation of the Grey Zone of Mutual Enterprises in Poland "Play Legally", since the Gambling Act came into force, the grey zone of the bookmaker has significantly shrunk. According to the report "Counteracting the Grey Zone in Poland", in the first months of 2017 after the entry into force of the Bookmaker's Act, in comparison with the same period in 2015, the grey zone of bookmaker's betting decreased from about 84% of the market share to about 62%. Moreover, already in the first 3 quarters of 2017, the State income from taxes paid on legally operating bookmakers increased by about 95% compared to the same period in the previous year. In other words: from January to September 2017, the State Treasury earned PLN 130 million.What did the Gambling Act do?The biggest revolution that the new Gambling Act introduced in 2017 was the Gambling Domain Register. Any website of a bookmaker and/or online casino offering illegal participation in the game to clients from Poland will be included in the register. Then, within 48 hours of the entry, each Internet provider in the country is obliged to block its customers from accessing the forbidden website.The same procedure resulted in many foreign operators withdrawing from Poland voluntarily (players from Poland were no longer allowed to play the game) or the road to them was closed. In this way, players who used their services primarily had to permanently move to Polish bookmakers with a license.The Bookmaker Act also increased the betting tax. The rate of each coupon is subject to 12% tax deducted from the stake, which is credited to the State Treasury (the exception is a special offer of the game without tax, but this does not change the fact that the money goes to the budget - not from your pocket, but from the bookmaker's account).New bookmakers in PolandSince foreign bookmakers withdrew from Poland, many (even dozen or so) willing to open legal bookmakers' websites have reported to the Ministry of Finance, in accordance with the regulations. Rumours (and official information) stated that among them there were also popular operators from Europe, e.g. bet365 and William Hill.A year has passed. Superbet appeared on the Polish market, although only as a ground bookmaker. Not much? Compared to how many applications went to the ministry, it is not much. Will the pace of receiving one bookmaker a year by the players be maintained? There are many indications that something should be moving in the subject matter. New brands have already been confirmed, e.g. Totalbet and eWinner, which should start in 2018.Polish online casinoThe sport totalizator has been appointed as a monopolist in the provision of online gambling. The tender for the contractor of the contract, which is eKasino (Polish online casino), was announced only in the last days of August 2017 and resolved at the end of February 2018. The winner was Playtech, one of the largest and most popular casino software developers. This allows us to think positively about the eKasino project, as this is how the Polish online casino is called a year after the entry into force of the Gambling Act. The name is semi-official so far.The terms of the tender stipulated that Playtech has no less than 6 months, but no more than 9 months (counting from the date of signing the contract) to launch the casino in Poland. Since the relevant documents were signed at the end of February 2018, the casino should appear no earlier than in the last days of August, but no later than in the last days of November 2018. This means that the Polish online casino will be opened for about 1.5 years after the amendment to the Gambling Act comes into force.Why only one casino?As far as gambling is concerned (both online and real gambling), the rulers decided that it would be under strict state control. This is why both online casinos and slot machines will be under the supervision of a monopoly (authority), Totalizator Sportowy, which is, of course, a state-owned company.Why should there be only one online casino and there may be many bookmakers? We do not see any other reasons than one: there were already legal bookmakers in Poland (STS, Fortuna, Totolotek, LVbet, eToto, Millennium, forbet) who provided taxes to the budget. There were no online casinos, however, because the regulations did not allow for them before. It was decided that if Poles like to play online machines, online poker, etc., they should play - but only where it is easy to control.Who gained the most from Bookmaker's Act?Without thinking too long, you can clearly answer that the Gambling Act 2017 was the most profitable for the State Treasury and the bookmakers who received the Polish license. Before the new regulations came into force, 90% of the Polish market was in the hands of foreign operators who did not pay taxes. The register of Prohibited Parties already contains almost 1600 items and is still being supplemented with new ones, which seals the gambling market in Poland. Suffice it to say that in the first quarter of 2018, 48% of the Polish market belongs to STS and 30% to Fortune.What else is ahead of us?2018 is to bring us the e-Casino from Totalizator Sportowy and Playtech, a product we have been waiting for since the first information about the state monopolist appeared. Moreover, we expect at least one more new bookmaker (in June 2018 Cherry Online Polska was licensed) and we hope that foreign brands such as bet365, bwin or William Hill will finally be admitted to us.What are the chances of any major changes on the Polish gambling market? Very little, although we would like our law to legalize the popular bingo and facilitate the organization of poker tournaments. Will this happen? We can only wait.
